(January 11, 2005) – The South Dakota Legislature convenes today, and one of the first things on the agenda is a misdemeanor gun ban.
This new ban mirrors the federal Lautenberg ban. Ever since Congress passed this unconstitutional ex post facto law, it has been retroactively applied to permanently prohibit firearms possession by anyone who has ever been convicted of a “domestic violence” misdemeanor.
The federal ban has often been enforced against folks who have not committed any true act of violence. Spouses who were involved in nothing more than a loud disagreement and mothers who committed the crime of spanking their children have been permanently stripped of their right to bear arms in self-defense.
Now, politicians and bureaucrats in Pierre want to write this horrendous ban into South Dakota law. They have already introduced it as section 269 of Senate Bill 43. This proposed state ban creates new penalties in addition to those that now exist on the federal level. If it is passed, a person could be convicted under both state and federal law and suffer double the penalty. Its passage would also undermine the effort to repeal the current federal ban.
Action:
Make one call and leave a message for your state Senator and for Sen. Schoenbeck, the sponsor of the ban.
Ask your Senator to oppose the misdemeanor gun ban, which is section 269 of SB 43.
