(February 4, 2005) – The Schoenbeck gun ban will be brought up for its first vote tomorrow afternoon, or possibly on Monday.

 

The committee hearings on Senate Bill 43 begin today, and will run through tomorrow.  As you know, the Schoenbeck ban is found in section 269 of this bill.

 

SDGO lobbyists are in Pierre right now, working to defeat this gun control measure.  They need your help to get the job done.

 

Action:

 

Please contact the members of the committee listed below and voice your opposition to the gun ban in section 269 of SB 43.  Even if none of them is your Senator, or if you have already contacted them, they need to here from you now. 

 

You can leave a message for them at the Capitol anytime before 5 pm, CST, today.  The number is (605) 773-3821.

 

Ask them to oppose the misdemeanor gun ban, section 269 of SB 43.

 

You can also use the sample letter to email them any time before the middle of tomorrow, when SB 43 will likely be brought to a vote.  You can send your email to the address listed under each Senator’s name, or to be sure your message is delivered, click on his name to use the online legislative email system.  Each Senator should be able to pick up your message sent via the system while he is at the Capitol.

Dear Senator:

 

There is a lot of misinformation being spread about the gun ban proposed in section 269 of SB 43.  The bottom line is that this gun control measure duplicates the onerous federal Lautenberg ban.

 

Despite claims made to the contrary, the proposed ban could increase the penalty for anyone who has been trapped by the federal ban and who subsequently uses a firearm for self-defense.  The proposed state-level ban is clearly an ex post facto law that violates both the state and federal constitutions.

 

I care deeply about the folks who have been victimized by the horrendous federal ban.  I strongly support any plan that would truly help them, and oppose any new legislation that would worsen their plight.  That is why I oppose section 269 of SB 43.  There is nothing in federal law that would require federal officials to lift the federal ban because of a comparable state ban, restoration of civil rights arguments not withstanding.  At the same time, there is nothing to keep the proposed state ban from increasing the penalty.

 

Please defend the people who have been victimized by the Lautenberg gun ban by voting against section 269 of SB 43.  Don’t entrench this bad federal law in South Dakota.

Seems like Schoenbeck can't quite level with people. I called the NRA-ILA they say that they are neutral and don't support the Schoenbeck proposal. So I wrote Mr Schoenbeck and told him he should try honesty.
